Introduction

These Terms & Conditions apply to your use of the BMA Electrics Pty Ltd website and, where relevant, electrical services provided by BMA Electrics. By using our website, requesting a quote, accepting a quote or engaging BMA Electrics to perform work, you acknowledge these Terms & Conditions. Any specific terms included within a written quote, proposal, work order or agreement provided by BMA Electrics will also apply to the relevant work.

Our Services

BMA Electrics provides residential, commercial and other electrical services within our service areas. The exact scope of work for each project will be determined by the quote, work order, written correspondence or other agreement between BMA Electrics and the customer. Services may be subject to availability, property access, site conditions, material availability and applicable electrical safety requirements.

Quotes and Estimates

Quotes are prepared based on the information available to us at the time. Unless otherwise stated, a quote only covers the products, materials, labour and services specifically described within it. Additional work, unforeseen site conditions, changes requested by the customer or work that could not reasonably have been identified before commencement may result in additional costs. Where practical, we will discuss additional work or variations with you before proceeding.

Acceptance of Work

A quote may be considered accepted when you confirm acceptance in writing, approve the work electronically, pay a requested deposit or otherwise instruct BMA Electrics to proceed. Once work has been accepted, we may schedule labour, order materials and make other arrangements required to complete the project.

Changes and Variations

If you request changes after a quote has been accepted or after work has commenced, the price and completion timeframe may need to be adjusted. Variations may include:

  • Additional electrical work
  • Changes to fittings or fixtures
  • Changes to quantities
  • Changes to locations or installation requirements
  • Additional labour
  • Additional materials
  • Work required due to unforeseen site conditions

We will aim to communicate significant variations before carrying out additional work where reasonably practicable.

Access to the Property

You are responsible for ensuring BMA Electrics has safe and reasonable access to the property at the agreed time. This may include access to switchboards, roof spaces, ceiling cavities, walls, electrical equipment, work areas and other parts of the property reasonably required to complete the work. If we cannot access the property or safely complete the scheduled work, the appointment may need to be rescheduled.

Existing and Unforeseen Conditions

Electrical work can sometimes uncover conditions that were not visible or reasonably identifiable before work commenced. These may include faulty existing wiring, non-compliant installations, damaged equipment, restricted access, asbestos-containing materials, structural issues or other existing conditions. If additional work is required because of an unforeseen condition, we will discuss the issue and any additional work required wherever reasonably practicable.

Pricing and Payment

Prices will be provided through the relevant quote, invoice, work order or other communication from BMA Electrics. Payment must be made in accordance with the payment terms stated on the relevant quote or invoice. Where a deposit or progress payment is required, this will be communicated before work proceeds. Any additional work or approved variation may be invoiced separately or added to the final invoice.

Materials and Products

Where BMA Electrics supplies electrical fittings, fixtures, components or other products, we will use products we consider suitable for the agreed work. Product availability may change from time to time. Where a specified product is unavailable, we may discuss an appropriate alternative with you. Manufacturer warranties may apply to certain products independently of BMA Electrics.

Delays

We will make reasonable efforts to attend appointments and complete work within agreed or estimated timeframes. However, delays may occur because of circumstances outside our reasonable control, including:

  • Material or supplier delays
  • Severe weather
  • Site access issues
  • Unexpected electrical or structural conditions
  • Changes to the scope of work
  • Illness or staff availability
  • Events affecting the safety of our electricians or customers

Where possible, we will communicate significant delays and arrange a suitable alternative.

Cancellations and Rescheduling

If you need to cancel or reschedule an appointment, please contact BMA Electrics as early as possible. Where materials have already been specially ordered, work has commenced or costs have been incurred specifically for your project, those costs may still be payable where legally permitted. Any specific cancellation conditions provided within an accepted quote or agreement will also apply.

Electrical Safety

Safety is a priority for BMA Electrics. We reserve the right to stop, postpone or refuse work where we reasonably believe conditions are unsafe, access is unsuitable or proceeding could create a risk to people or property. Electrical work will be undertaken in accordance with applicable electrical safety requirements. Where required, applicable electrical compliance documentation will be provided in accordance with relevant requirements.

Customer Responsibilities

You are responsible for providing accurate information about the property and requested work. You should inform us about any known hazards or relevant conditions before work begins, including restricted access, asbestos, structural concerns, hazardous materials or other trades operating within the work area. You are also responsible for obtaining any permissions, approvals or authority required from property owners, landlords, building managers or other relevant parties unless otherwise agreed.

Workmanship and Consumer Rights

BMA Electrics aims to provide electrical services with appropriate care, skill and attention. Our services may also come with guarantees and rights that cannot be excluded under the Australian Consumer Law. Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded.

If you believe there is an issue with work completed by BMA Electrics, please contact us as soon as reasonably possible so we can review the matter.

Damage and Existing Property Conditions

We take reasonable care while carrying out electrical work. Some electrical work may require access through walls, ceilings, cabinetry, flooring or other finished surfaces. Where this is reasonably required to complete agreed electrical work, minor disturbance or access work may be unavoidable. Unless specifically included within the agreed scope, repairs such as plastering, painting, carpentry, tiling or other non-electrical finishing work may need to be completed separately. BMA Electrics is not responsible for pre-existing damage, defects or conditions that were not caused by our work.

Limitation of Liability

To the extent permitted by law, BMA Electrics will not be liable for indirect or consequential losses arising from circumstances outside our reasonable control. Nothing in these Terms & Conditions limits any liability, consumer guarantee or other right that cannot legally be excluded or limited under Australian law.
